By using AYLE’s Website and/or placing an order on our online store, you agree to be bound by the following Terms and Conditions and User Terms:
1. GENERAL TERMS
The entire use and management of AYLE (‘us’, ‘our’) and our website www.ayle.co are the responsibility of the company registered under the name of Patrícia Correia, with head office at Rua do Padrão, nº393, Loja B, 4560-071 Duas Igrejas, Penafiel, Portugal. Contact: (+351) 964018185 and E-mail: email@example.com.
AYLE dedicates itself to commercializing furniture and home accessories with an original and distinctive design. All of AYLE’s products are created exclusively for our clients, and identified with a serial number that proves that very same exclusiveness. For this reason, AYLE does not display stock availability.
The content on this website was created and published in good faith. It is entirely devoted to providing information about AYLE’s products, as well as to make them available to prospective clients in our online store, where they can purchase our products and place orders at their own risk.
2. OBJECT AND SCOPE
These terms and conditions apply to AYLE and the individuals/companies, hereby designated as clients, who visit our website www.ayle.co and use our online store.
Both parties agree that our relationship is exclusively regulated by this contract, except for any previous conditions available on the Website. Should any condition be omitted, it will be regulated by Decree-Law nº 24/2014 of February 14, Portuguese law.
AYLE reserves the right to change these Terms and Conditions without further notice. Any changes will be published on our website www.ayle.co.
3. CONTENT AND INTELLECTUAL PROPERTY
By content we mean all the information available for our website user, such as text, images, galleries, videos, web design and software. All content comes from the intellectual effort of all AYLE’s members and it is licenced and protected by authorial rights, as well as by Portuguese law and European Union law. All content must not be used outside these terms and conditions without AYLE’s consent.
AYLE reserves the right to modify any information and commercial offer concerning its products, prices, sales promotions, and commercial and service terms at any time.
All pictures shown on this website are for illustration purposes only. Even though they depict real products, the final product may display some differences, especially regarding differences in colours and undertones for woods, marbles and genuine leathers. As such, AYLE recommend you and all our clients to consider the product’s full description in order to attain the most information possible.
If the information does not correspond to the product’s real characteristics, the client has the right to rescind the contract under common law.
All contractual information is written in English, as well as all information regarding products, any email exchange and the actual sale.
All products commercialised at www.ayle.co are in conformity with the law of Portugal.
AYLE declines any responsibility in case of any violation of the law of another country to where we might ship our products. It is our clients’ responsibility to check with their local authorities on specific laws and regulations on imported goods and their use. AYLE is not liable for any loss or damage caused by a distributed denial-of-service attack, viruses or other technologically harmful material that may infect your computer equipment or cause temporary problems with accessing, browsing or buying on our website.
5. CLIENT AND USER RESPONSABILITIES
Both clients and users commit to abide and respect these Terms and Conditions and User Terms, such as:
a. To abstain from inserting, storing or spreading obscene, objectionable, xenophobic or racial and/or any kind of content that violates public and fundamental principles and rights through on our website;
b. Not using fake identities;
c. Providing correct personal data and address, so that AYLE can process your order accordingly.
AYLE refuses any responsibility for possible delays or any impediment of delivery beyond our control, such as insufficient data provided by a client.
In order to purchase goods from this website you must be over 18 (eighteen) years of age.
Before ordering any product, you should check if they have the appropriate dimensions and if there is easy access for delivery.
By validating an order, the client has acknowledged and irrevocably accepted these Terms and Conditions, available at www.ayle.co.
All data processed by AYLE serves as proof of transactions between AYLE and the client. It is AYLE’s responsibility to save the digital contract and keep it accessible.
As soon as your order is submitted, you will receive an order confirmation email. In case the details are wrong, you can request their amendment to firstname.lastname@example.org, until the order has been shipped.
When buying any products at www.ayle.co, AYLE accepts the following types of payment:
Credit cards: Visa, American Express and Master Card;
8. PRODUCT AVAILABILITY
AYLE only processes orders after the respective proof of payment has been provided. Production time and shipping varies according to the specificities of each product that has been ordered. For more information, visit each product’s page at www.ayle.co for more information.
To the estimated shipping time, delivery time should also be considered, as it depends on the courier and destination. AYLE only ships on working days. This means weekends and holidays are not included on the estimated delivery date. Hence, estimated deliveries are a mere indication to the client and do not amount to contractual obligation to deliver at the time stated.
Shipping costs can be simulated during an order. These costs may vary according to a product’s weight and dimensions, as well as distance to delivery point.
The client is notified once the order has been shipped, and may follow their order’s progress via the available tracking number.
All AYLE products are checked before being shipped, and carefully packed in secure customized packaging, so that they will be delivered in the best condition. However, it is the customer’s responsibility to inspect each item upon delivery. If an item has been damaged during transportation and displays visible damage, the delivery must not be accepted. The damages must be recorded and signed by both the customer and carrier. If an item has been damaged during transportation and the damages were not visible, the customer must notify AYLE within 48 hours, including photos of the packaging and product. Claims falling outside this period will not be considered. AYLE may rely on different carriers, depending on product size and requirements, and cannot be held responsible for delays that are beyond its control.
10. LIMITED LIABILITY
Wood, leather and marble are natural materials. For this reason, grain characteristics and color can vary from piece to piece. AYLE shall not be responsible for any such variations, nor any deterioration resulting from ordinary use of the goods sold, nor any deterioration arising from their incorrect use. In the event of AYLE being liable to the client, the total amount of compensation payable shall not exceed the total price of the goods sold and shall not cover indirect or consequential damages.
11. PRODUCTS GUARANTEE AND POST-SALE ASSISTANCE
In compliance with Decree-Law nº 67/2003 of April 8, in result to alterations introduced by Decree-Law n. 84/2008 of May 21 of Portuguese Law, all commercialised equipment at www.ayle.co is covered by a guarantee of conformity of goods correspondent to a 2 year period.
If the product is faulty or damaged, the client must inform AYLE and provide a respective order number and a full description of such flaw. Initially, all costs associated with returns are completely at the client’s own expense, but will be reimbursed by AYLE within a seven (7) day period after a technical evaluation that successfully indicates the product is indeed faulty or eligible to be repaired or replaced by AYLE. A full refund will be given to the client by the same method as the original payment, unless otherwise indicated. If a product does not fully meet the return criteria after close evaluation, or if a product is not eligible to be repaired or replaced under the Portuguese consumer protection law, AYLE will refuse any type of refund and will not take responsibility for any costs to deliver a product back to a client’s address. In this case, AYLE will send the client a fully detailed report, explaining all reasons and facts to why repair costs will not be payed or why the product will not be replaced. AYLE will also indicate delivery cost so that the product can return to the client’s address and will inform that, even though AYLE does not cover repair costs or replace the item, the client can still request for the product to be repaired at their own expense and suggest a budget for that very same repair.
The client has a fourteen (14) day period, after a refusal report form has been sent to them, to request delivery to their address and to pay for delivery costs. Once delivery costs have been payed and confirmed, AYLE will send the product to the client’s address within five (5) days.
The client can request a repair and pay for its costs within the same fourteen (14) day period. In this case, AYLE will send the product to the client’s address after it has been repaired within a five (5) day period. This delivery depends on associated costs.
Once AYLE receives your product, there will be a technical evaluation. If the product is eligible, it will be replaced. In this case, AYLE will proceed to its replacement and ship it to the client’s address with no extra cost.
If the technical evaluation detects any signs of misuse and/or any external factors that might have damaged the product (e.g. if the item has been dropped, humidity, etc.), the client will be contacted for an agreement. AYLE will indicate a repair budget, at the client’s own expense. In this case, the product will be forwarded to Technical Assistant. If the client declines, they can request the product to be sent back to their address, as previously mentioned.
If the product is no longer under the legal guarantee period of two years, the client can still request it to be repaired, by informing AYLE and sending the products over for repair. The products will be analysed by the Post-Sale Service at AYLE. This service will provide a technical report and a repair budget. Any repair service will only take action after the client has explicitly accepted the budget. Delivery costs are always at the client’s own expense.
